Terms of Service

These Terms are an agreement between you and Gigafriend (“Gigafriend,” “we,” “us”) and govern your use of the Gigafriend apps and website (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.
1. What Gigafriend is
Gigafriend is a marketplace that lets people who want company, an activity partner or a hand (“Hosts”) find and book independent members who offer their time (“Friends”). Gigafriend provides the platform, matching, scheduling, messaging, safety tools and payments. Gigafriend does not provide the services itself, does not employ Friends, and is not a party to the arrangement between a Host and a Friend.
2. Platonic company only
Gigafriend is strictly for platonic company, activities and help. Requesting, offering or providing romantic, sexual or intimate services of any kind is prohibited and will result in immediate removal from the Service and may be reported to law enforcement.
3. Eligibility and accounts
- You must be at least 18 years old and able to form a binding contract.
- You must give accurate information, keep it up to date, and keep your login secure. You’re responsible for activity on your account.
- One person, one account. Accounts may not be shared, sold or transferred.
- Friends must complete identity verification, and a background check for gig types that require one, when we ask.
- The Service launches city by city; some features are only available in launch cities.
4. Friends are independent
Friends are independent contractors, not employees, agents or partners of Gigafriend. Friends decide whether to list themselves, set their own rates and hours, choose which requests to accept, and control how they spend their time with Hosts, within these Terms. Friends are responsible for their own taxes.
5. Bookings, fees and payments
- A Friend’s rate is shown before you book. The price is fixed when you send a request. Hosts pay the Friend’s rate plus a Gigafriend service fee, both shown before booking.
- Each gig shows its expense arrangement (for example, who pays for tickets or food). Hosts and Friends agree to follow it.
- Once payments are enabled, all payments must go through the Service. Arranging to pay or be paid outside Gigafriend for someone you met here is not allowed.
- Cancellation and late-cancellation fees, overtime and tips will be shown in the app when they apply.
6. Safety rules
- First meetups with someone new must take place in a public place for gig types that require it.
- Treat everyone with respect. Harassment, discrimination, threats and violence are prohibited.
- Don’t ask for or share contact details to move a booking off the Service.
- Don’t misrepresent who you are, impersonate anyone, or create fake reviews.
- Don’t use the Service for anything illegal, including the use, sale or provision of illegal substances.
- Report problems through the app. In an emergency, call 911 first.
7. Your content
You own the photos, videos, text and other content you post. You give Gigafriend a worldwide, non-exclusive, royalty-free license to host, display and distribute that content to operate and promote the Service. You confirm you have the rights to what you post and that it follows these Terms. We may remove content that breaks these Terms.
8. Ratings and reports
Ratings must be honest and based on a real gig. We review reports and may investigate, remove content, suspend or close accounts, cancel bookings, and cooperate with law enforcement where appropriate.
9. Suspension and termination
You can close your account at any time. We may suspend or close accounts, or remove listings, that break these Terms or put others at risk, and we may change or discontinue parts of the Service.
10. Disclaimers
Gigafriend verifies certain information and provides safety tools, but we can’t guarantee the conduct, identity or background of any member, and verification or background checks are not a guarantee of safety. Use good judgment and follow our safety guidance. The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law.
11. Limitation of liability
To the fullest extent permitted by law, Gigafriend is not liable for indirect, incidental, special, consequential or punitive damages, or for the acts or omissions of any member. Our total liability for any claim relating to the Service is limited to the greater of the fees you paid Gigafriend in the 12 months before the claim or US$100.
12. Indemnity
You agree to defend and indemnify Gigafriend against claims arising from your use of the Service, your content, your gigs, or your violation of these Terms or the law.
13. Disputes and governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Before filing a claim, you agree to contact us at [email protected] so we can try to resolve it informally. Any claim that isn’t resolved will be brought in the state or federal courts located in Travis County, Texas, and you and Gigafriend consent to their jurisdiction.
14. Changes
We may update these Terms. If we make material changes, we’ll notify you in the app or by email before they take effect. Continuing to use the Service after that means you accept the updated Terms.
